What is the latest with the case?

The I130 has been sent into The Department of Homeland Security. We've been told it takes 5 months to get approved. So we should know something in January or February of 2010.  It is the first step in the process to getting Marcelo back home.  The I130 is the form needed to prove that Marcelo and Melanie have a ligitimate marriage.  Once this form is approved, then they will be sent a letter with their date of interview in Buenos Aires, Argentina. That could take another year or longer.  At the interview, it will be decided in front of someone if Marcelo is let back into the U.S. or not. The problem with the interviews is it's only based on how the interviewer feels.  We have to make an impression on someone who hears thousand's of cases and see if we stand out at all. It could just as easily be denied as approved.

That is the first avenue that the family is taking.  The second avenue is that they have had a meeting with the office of "Congresswoman Linda Sanchez".  The family has met with her Congressional Aide who stated that the only thing he can do is call and inquire on Marcelo's case and that is exactly what he's in the process of doing now. 

Marcelo is currently living in Argentina but being full blooded Italian, he has rights to live in Italy. It is possible that he can have dual citizenship with Argentina and Italy and is currently working to get citizenship in Italy. We do not know where that will take the family but they are working on all avenue's. We will continue to update as new information arises.
